How To Sue Over A Car That Is A Lemon And Was Told It Wasnt Can You Help Please?
I bought a car april 18th of this year, and picked it up on the 20th of april. I was told I would be the 2nd owner and that this car had no problems and has never been in a accident. I found out today this car has been wrecked! The brake on the left front tire had no screws holding it together, and I did a car fact and a auto checked and found out im the 6th owner and this car was used by a rental company and was put in auction 2x. I bought this car from a man who stated it was in great codntion but only hid all the problems is there any way I can get info online to do something about this? I live in the central, ca area (fresno, hanford, lemoore, etc) the 559 area. Any info can help. My husband is deployed to iraq ans i have a 5 month old and 3 year old. This is my first deployment and I got taken on a ride over this car..So im lookin for any info to sue this guy for just the cost of repair. Thanks!!

You should have had the car inspected before you bought it. If you bought it as is you probably are not going to get anything out of suing him. Suing someone is not cheap and if you lose you have all the lawyer and court costs to worry about. You might see if the Better Business Bureau will do anything for you.
Sorry to say but you are probably SOL. There are plenty of “Lemon Lawyers” where you are. I am in Camp Lejeune and I’m looking for a new car and I’m worried about the same thing. I would try to get ahold of a lawyer, try one on base first since it’s free for you and see if there is anything. I believe since it was from a private seller there is nothing you can do unless there is paperwork saying he told you those lies. But definitely go talk with LSSS to get advise.
The lemon law applies only to new cars with mechanical or electrical defects that a dealership is unable to correct in a reasonable time. I’m sorry to tell you that you are probably out of luck here. A used car is purchased “as is”, meaning that the seller is not responsible for failures after the sale. The buyer is responsible for everything.
However, you may have a case for fraud or material misrepresentation, but it will likely be your word against the word of the seller, since you probably have nothing in writing. It would require an attorney and you’d have to sue the seller.
Sadly, as you’ve found out, the Carfax or Autocheck should have been done before you closed the deal. It would have saved you a lot of grief. If your husband is deployed, is there any chance you would have access to free legal advice? That’s the first place I’d go.

I am not sure what the law is where you are but you may have a case to take the other party to court for miss representation

Now you have to do quite a bit of research. Find out about your state’s lemon law. Go back to the dealer and let him know that you know what your rights are, and you expect him to follow the law or you will report him to the better business bureau. The problem with used cars, is let the buyer beware. Unless it is in the contract, you buy it at your own risk unless he has deliberately hidden some flaw from the car. You may have to involve a lawyer if there is fraud in the case, such as you stated you were the 2nd owner and no accident. When you buy a new car, ALWAYS run a vincheck. Always. It’s worth it. This is a huge investment, and you can’t trust anyone. You have to do your research first on all used cars.
